Unlawful sexual intercourse (Statutory rape)

Information on the crime of unlawful sexual intercourse, also known as statutory rape, is found at penal code sections 261.5(b), 261.5(c), and 261.5(d).

PC 261.5 Laws (Abbr.)

PC 261.5(a) Unlawful sexual intercourse is an act of sexual intercourse accomplished with a person who is not the spouse of the perpetrator, if the person is a minor. For the purposes of this section, a “minor” is a person under the age of 18 years and an “adult” is a person who is at least 18 years of age.

PC 261.5(b) Any person who engages in an act of unlawful sexual intercourse with a minor who is not more than three years older or three years younger than the perpetrator, is guilty PC 261.5(b).

PC 261.5(c) Any person who engages in an act of unlawful sexual intercourse with a minor who is more than three years younger than the perpetrator is guilty of PC 261.5(c).

PC 261.5(d) Any person 21 years of age or older who engages in an act of unlawful sexual intercourse with a minor who is under 16 years of age is guilty of PC 261.5(d).

Sexual intercourse is any penetration, no matter how slight, of the penis into the vagina. Ejaculation is not required to prove penetration.

Note: Unlawful sexual intercourse is the legal term for the crime more commonly known in society as statutory rape.

PC 261.5 Sentences & Punishments

Probation Sentence: A probation sentence is period of supervision instead of a prison sentence. Probation sentences carry conditions of probation, or terms of probation, that must be followed in order to avoid further punishment, including an actual prison sentence. A probation sentence for felony PC 261.5(c) and 261.5(d) is called felony probation and is supervised and monitored by a felony probation officer. A probation sentence for misdemeanor PC 261.5(b), 261.5(c) and 261.5(d) are called informal probation sentences and are not monitored or supervised by a probation officer but rather by the court. Probation sentences for statutory rape crimes are available but whether or not a defendant will be granted a probation sentence on any statutory rape conviction depends largely on the facts of the case and the defendant's criminal history.

Sex Offender Registration: If found guilty of statutory rape (PC 261.5(b) 261.5(c) or 261.5(d)), the defendant will not ordinarily be required to register as a sex offender.

Caution: If the judge finds that a statutory rape was committed for the purpose of sexual arousal towards minors the judge may order the defendant to register as a sex offender. This is an unusual order in a statutory rape case but the law does exist to give the judge the power to make such an order (See PC 290.006).

Jail or Prison Sentence: Statutory rape charged under PC 261.5(c) or 261.5(d), is classified as a wobbler, which means the crime is charged as a felony or as a misdemeanor. The maximum sentence after a conviction for felony PC 261.5(c) is three (3) years in state prison. The maximum sentence after a conviction for misdemeanor PC 261.5(c) is one (1) year in county jail. The maximum sentence after a conviction for felony PC 261.5(d) is four (4) years in state prison. The maximum sentence after a conviction for misdemeanor PC 261.5(d) is one (1) year in county jail.

Note: Statutory rape charged under PC 261.5(b) is only charged as a misdemeanor and the maximum sentence for PC 261.5(b) is one hundred eighty (180) days in jail.

Whether or not the district attorney files felony or misdemeanor charges in any PC 288a(b)(1) case depends largely on the facts of the case and the defendants criminal history. In some cases, it may be possible for a criminal defense attorney to pursuade a judge that the charges should be reclassified from a felony to a misdemeanor.
